Vovici Anti-SPAM Policy
Last Revised: 4/1/2005
As the developer and provider of software and hosting services that include tools and services for for sending bulk emails messages to invite survey participation, we have implemented this Anti-SPAM policy to:
- Help prevent our software and services from being used to send unsolicited emails or email campaigns.
- Respond to complaints about use of our software and services as a vehicle to send unsolicited email.
- Clarify our use of permission-based email marketing and research practices.
- Ensure our clients are in compliance with the requirements of the 2003 CAN-SPAM Act.
Our Policy
We have zero tolerance for Unsolicited Commercial Email (a.k.a. SPAM or UCE) that is in any way associated with our software, our hosting service, our customers, and our internal marketing and research effort. As a user of our software and hosting services, you are prohibited from using UCE as a means of conducting surveys hosted by us or implemented using our technology. Examples of behavior that we consider to be in viloation of our Anti-SPAM Policy include, but are not limited to:
- Sending or employing a third party to send survey related email messages to people who have specifically requested NOT to receive such emails.
- Forging of survey related email message headers to hide the identitiy of the true originator of the email message.
- Harassment, whether through language, frequency, or size of survey related email messages.
- Any bulk emails sent without valid unsubscribe links or that in any other way do not comply with the requirements of the 2003 CAN-SPAM Act.
Our definition of UCE does not include sending survey related email messages to employees, business partners, students, customers, members, or any other group that you communicate with on an ongoing or regular basis. Examples of behaviour that we consider to be acceptable include:
- Renting lists from third-parties who assure opt-in or double opt-in inclusion, and where the service providers have provided clear opt-out or unsubscribe opportunities.
- Using opt-in or double opt-in lists you develop or have developed for survey panels, newsletters, newsgroups, or user groups.
The following sources of email lists are usually NOT acceptable:
- Lists generated with web spiders.
- Email addresses collected from discussion lists or newsgroups.
- Lists generated with email address collector programs.
Generally speaking, any email list created in a way that does not offer a choice about inclusion is considered a SPAM list and your use of such an email list is a violation of our Anti-SPAM Policy. If you have a question about whether your email list is appropriate, please contact us for assistance.
Our Response
If we receive more than one substantiated complaint about SPAM directly related to your use of our software, hosting service, or bulk email service, regardless of the source of your email list, we reserve the right to immediately and permanently shut down your hosting account without refund.
If you have used our bulk email service to send UCE, we will terminate your email job if it is still running, without refund, and will bar you from future use of our products and services. We will also charge you for all costs associated with investigating and prosecuting you for misuse of our products and services.
Think you've been SPAMMED?
Please forward a copy of the email message your received to us and provide any other information that you believe may help us in our investigation. We will promptly respond to your email and take the appropriate action.
We take SPAM prevention very seriously.
